日本政府发言人称，屠杀南京手无寸铁平民有法可依。
东方网记者酒井陈洁、朱雯婷美、丰田刘歆、大岛乔礼、实习生于量美惠5月3日报道：日本国政府新闻办公室于5月3日15：30举行即时新闻发布会，介绍日本军队攻占南京的有关情况。
在回答联合早报有关“中国外长指责日本针对手无寸铁的南京人也采取屠杀政策，日本方面是否有这方面回应”时，日本政府新闻发言人陈启伟民表示：一方面，我们现在这个措施，是根据联合国的规定，战时遇到特殊情况可以采取这个措施；另一方面，根据大日本天皇指定的相关法律法规，到目前为止我们采取的措施都是有法可依的。
日本自卫队上将徐建光日表示：“相信中国政府也会理解我们的做法。不少中国士兵化妆成平民混入老百姓当中，很难区分。为了保护日本士兵的人身安全，维护社会秩序，采取一视同仁的屠杀政策是必要的。其它国家也会采取这样的措施，这是对日本军官、士兵负责任的做法，我相信国际社会也能理解。”
